Qualifying Windows and Damages

This settlement covers claims of wood rot to the windows themselves, additional damage caused by water leakage, and qualifying prior repairs to windows manufactured by Windsor Window Company (“Windsor”) and Woodgrain Millwork, Inc. (“Woodgrain”) about Pinnacle and Legend Series (including Legend Hybrid) windows manufactured between January 1, 2000 and January 5, 2018.

Mulled Windows

The follow are examples of "Mulled Windows". A mulled window is a window which uses mullion components to structurally join two or more window units together. A mulled window occupies a single opening in a wall, but consists of more than one window unit joined together to fill the space.

The following are examples of labels that may appear on your window’s corners or between your window’s panes that identify, among other things, whether Windsor manufactured your windows, when that occurred, and what type of window you have.

Qualifying Damage


A. Qualifying Damage to the Sash

The following examples show visible wood rot to a Qualifying Window sash that is contiguous to any potential leak path. This Qualifying Damage may be evidenced by staining, discoloration, and/or deterioration. Staining or discoloration alone, however, is not sufficient to support a claim.



B. Qualifying Damage to the Frame

The following examples show visible wood rot to a Qualifying Window frame other than the sash that is contiguous to any potential leak path. This Qualifying Damage may be evidenced by staining, discoloration, and/or deterioration. Staining or discoloration alone, however, is not sufficient to support a claim.



C. Qualifying Additional Damage

The following example shows water damage caused by a Qualifying Window to a wall and siding. This Qualifying Damage may be evidenced by water damage to walls, drywall, insulation or other home or building materials caused by water intrusion.
